RETURNS AND COMPLAINTS

Right of withdrawal
In accordance with the provisions of the Consumer Protection Act, the buyer has the right to notify the supplier within 14 days of taking delivery of the goods that he/she withdraws from the contract without having to give a reason for his/her decision.

In order to withdraw from the contract, the buyer must send the completed form to the provider's address or in scanned form by e-mail to info@crnozrno.com.

The product must be returned within 14 days of the date of the withdrawal. The product must be returned to Alexander Nino Ruiz s.p., Perovo 13B, 1290 Grosuplje, Slovenia undamaged, unused, complete and in its original packaging. In this case, the buyer will be responsible for the shipping costs.

Refunds will be made immediately or, at the latest, within 14 days of receipt of the cancellation notice. The Provider shall return the payments received to the Buyer by the same means of payment as used by the Buyer, unless the Buyer has expressly requested the use of a different means of payment and the Buyer bears no costs as a result. The Provider may withhold the reimbursement of payments received until the return goods have been collected or until the Buyer has provided proof that he has sent the goods back.

In the case of an off-premises contract, where the goods are delivered to the home at the time of conclusion of the contract, the supplier shall take delivery of the goods at his own expense if, due to the nature of the goods, it is not possible to return them in the usual way by post.

Material defects

A defect in workmanship shall be deemed to exist if:

- the goods do not have the characteristics necessary for their normal use or circulation
- the goods do not have the characteristics necessary for the particular use for which the buyer is purchasing them, which was known or ought to have been known to the seller
- the goods do not possess the characteristics and qualities which were expressly or tacitly agreed or prescribed
- the seller has handed over an article which does not correspond to a sample or model, unless the sample or model was shown for information only.

The suitability of the product for normal use shall be examined in relation to normal goods of the same kind and in the light of any representations made by the supplier or the manufacturer concerning the characteristics of the goods, in particular by means of advertising, the presentation of the product or indications on the product itself. The Buyer must notify the Supplier of any material defect, together with a precise description thereof, at the Buyer's own expense, within the statutory period of two years from the date of acceptance of the goods and must allow the Supplier to inspect the product.

The buyer who has duly notified the supplier of a material defect shall be entitled to claim from the supplier:

- rectification of the defect in the product,
- or the return of part of the amount paid in proportion to the defect,
- or a refund of the amount paid.

The right to claim for material defects is regulated in more detail by the Consumer Protection Act.

Return of damaged shipments

In the event that the Buyer discovers on receipt of the consignment that the products ordered are damaged, inoperable or missing parts, the Buyer may return the goods to Alexander Nino Ruiz s.p., Perovo 13B, 1290 Grosuplje, Slovenia. In this case, the shipping costs will be borne by the provider. The two parties shall then agree by mutual agreement on the possible replacement of the product or refund of the purchase price.

Damage

The Provider shall not be liable for damages arising from improper, irresponsible or negligent use of the Products.
